TERMS OF SERVICE

 

Please read this carefully. By accessing the website located at www.mamasuorganic.com (the “Site”) and/or purchasing any products (“Products”) or services (“Services”) made available on the Site, you are automatically bound by all of the terms and conditions (“Terms”) set out herein. If you do not agree with all of these Terms, please do not use the Site and do not purchase any Products or Services and do not continue to access the Site.

 

Your use of the Site constitutes your agreement to follow and be bound by these Terms. From time to time and without notice, these Terms may be modified. Neither the Site nor the Products or Services are intended for use by anyone under the age of 18.Each time you use the Site, you signify your acceptance and agreement of the then-current version of these Terms, and certify that you are above the age of 18.

 

If you are under the age of 18, you certify that you have parent or guardian permission to use the Site and Products, and your parent or guardian agrees to be bound by these Terms.

 

1. Disclaimer

 

The information and recommendations offered on the Site are for informational purposes only. The Site and all contents of the Site are provided on an “as is” basis without warranties of any kind, either expressed or implied. You acknowledge, that the use of this Site and/or the purchase of any Products or Services is at your sole risk. Nothing contained on this Site is intended for medical diagnosis or treatment, nor is it intended to cure, prevent any disease or medical condition. The advice given is not intended to replace the advice of your medical practitioner. If you are currently under the care of a physician, or are currently being treated for any health condition, you should consult with your health care provider prior to using any of the Products or Services. If there is a change in your medical condition, you should immediately notify your doctor.

 

Our juices are raw and unpasteurized. From a nutritional perspective, fresh juice is best consumed raw and in its natural state. As is the case with any fresh fruits and vegetables, and products such as a salad or fruit cup, it may contain bacteria that may cause illness in children, the elderly, or individuals with compromised immune systems.

 

Neither we nor our experts, partners, shareholders, or any of their affiliates will be liable for any direct, indirect, consequential or other damages that may result including but not limited to, economic loss, injury, illness or death. We make no representations or warranties concerning the effectiveness of our Products. We shall be in no way responsible for the improper use or storage of our Products once they are delivered.

 

2. Integrated Nutrition Packages

 

All Integrated Nutrition Packages that are available for purchase on the Site are sold on behalf of Dawn Hart of Nutri-hart Personal Training and Nutrition. Both Dawn Hart and Nutri-Hart Personal Training and Nutrition are third parties and are not employees, consultants, shareholders, or directors of Mamásu, and therefore Mamásu, including its officers, directors, employees, agents,shall not be responsible for any direct, special, indirect or consequential damages, or any other damages of any kind whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way related to or connected with any Integrated Nutrition Packages that have been purchased from the Site.

 

3. Delivery Policy

 

Mamásu shall not be responsible for the loss or damage of any Products after they have been delivered to the destination address specified on the order receipt.

 

It is your responsibility to ensure that Mamásu has appropriate access to the destination address. If, for whatever reason, the security/concierge at your building, if applicable, refuses to accept the delivery and/or deny entry, Mamásu shall not be held responsible to re-deliver the shipment and shall not provide a refund for the Products. If delivery and/or entry is denied, then Mamásu will allow for pickup of the shipment at its production facility the following morning (email info@mamasuorganic.com to arrange time). The shipment must be picked up by the individual whose name appears on the order receipt.

 

Mamásu shall not be held responsible for delay or non-delivery of any shipment if such delay or non-delivery occurs by way of natural disaster, severely inclement weather, motor vehicle accidents or uncontrollable traffic conditions, lockouts, breakdown of machinery, or stoppage of labour.

 

4. Cancellations & Refund Policy

 

All Products purchased are non-refundable. However, the start date of a juice cleanse may be postponed on a one-time basis if 4 business days’ notice is provided via email to Mamasu’s email address (info@mamasuorganic.com). In this case, you will not be provided a refund, but your juice cleanse will be rescheduled to begin on another upcoming cleanse date. Alternatively, the Products can be transferred to a friend or family member with 24 hours’ notice prior to scheduled delivery, given that they reside in the City of Calgary and the updated delivery information is provided via email to info@mamasuorganic.com within the aforementioned 24 hour period.

 

5. Consent to Receive E-mails

 

By using the Site and providing your email address for any purpose, you consent to receive e-mails from Mamásu, which may include commercial e-mails.

 

6. Indemnification

 

You agree to indemnify, defend, and hold Mamásu its officers, directors, employees, agents and suppliers, harmless from and against any claims, actions or demands, liabilities, losses, costs, and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms.

 

7. Termination of Use

 

Mamásu reserves the right, in its sole discretion, to refund your purchase of any Products and terminate your access to Mamásu Products or Services at any time and without notice.

 

8. Copyright and Limited License

 

Unless otherwise indicated, this Site and all content and other materials on the Site, including, without limitation, Mamásu logos, and all designs, text, graphics, pictures, reviews, information, data, software, sound files, other files and the selection and arrangement thereof (collectively, the "Site Materials") are the proprietary property of Mamásu or its licensors and are protected by Canada, U.S. and international copyright laws.

 

You are granted a limited, non-sublicensable license to access and use the Site and electronically copy and print to hard copy portions of the Site Materials for your informational, non-commercial and personal use only; however, such Site Materials may not be redistributed to any third party

 

9. No Advice & No Client Relationship

 

The Site and the Products offered on the Site are for informational and demonstrative purposes only. The Site is not offering advice, recommendations, or an offer, solicitation or recommendation of any particular therapy, action or activity as suitable for you or your needs. You should always contact your physician before beginning any new activity, therapy or other course of action.

 

10. Limitation of Liability

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

 

Your use of the Site, Products and Services are at your own risk. In no event shall Mamásu or any of its independent contractors, service providers or consultants, or any of their respective directors, shareholders, employees and agents, be liable to you or any other person for any direct, special, indirect or consequential damages, or any other damages of any kind whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way related to or connected with any use of the Site, the Products, these Terms, the termination of these Terms, the content or the materials contained in or accessed throughout the Site, or your use of any Product, Service (such as the Integrated Nutrition Program), or any as a result of your use of the Site or the Services, including without limitation loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise (including without limitation by reason of any expenditures, investments, or commitments made in anticipation of the continuance or performance of these site terms), economic loss, under any theory of liability (whether in contract, tort, strict liability or any other theory of law or equity). Without limiting the generality of the foregoing, in no event will Mamásu ever be liable to you or any other person for any damages, loss or injury caused by or resulting from reliance by user on any information or opinion obtained from the site, or that result from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to Mamásu’s records, programs or services.

 

If, notwithstanding the above, Mamásu is liable to you or any other person, then the aggregate liability of Mamásu, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory of liability, shall not exceed any monies paid by you, if any, to Mamásu for access to or use of the Site or any Products.

 

11. Third Party Content

 

Mamásu may provide links to websites and content of third parties as a service to those interested in such links and content, and Mamásu may post third party content to the Site (such content is collectively referred to as "Third Party Content"). Mamásu does not monitor or have any control over and is not liable for any Third Party Content or third party web sites. Mamásu does not endorse or adopt any Third Party Content or third party website and can make no guarantee as to its accuracy or completeness. Mamásu does not represent or warrant the accuracy of any information contained therein and undertakes no responsibility or liability to update or review any Third Party Content or third party websites. Users use these links, Third Party Content and third party websites at their own risk.

 

Mamásu shall have no responsibility or liability of any kind for any Third Party Content encountered on or through the site, and any use or reliance on Third Party Content is solely at your own risk.

13. Applicable Law and Venue

 

These Terms and your use of the Site and any Products or Services shall be governed by and construed in accordance with the laws of the Province of Alberta applicable to agreements made and to be entirely performed within the Province of Alberta (even if your use is outside of the Province of Alberta), without resort to its conflict of law provisions. You agree that with respect to any disputes or claims not subject to arbitration (as set forth in these Terms), any action at law or in equity arising out of or relating to the Site or these Terms shall be filed only in the provincial and federal courts located in Alberta and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts.
